On July 18, 2024, the Ministry of Finance held another consultation meeting on the National e-Invoicing System (KSeF). The meeting was organized by the Ministry of Finance and the National Tax Administration (KAS). Participants in the discussion had the opportunity to review the results of the pre-consultation to date and discuss proposals for further simplification of the KSeF system.  

  

Summary of Consultations to Date  

  

Jaroslaw Neneman, Undersecretary of State at the Ministry of Finance, stressed that the obligation to use KSeF will cover a wide variety of entities. For this reason, it is extremely important to conduct thorough consultations that will help develop solutions tailored to the specific activities of different businesses.   

  

Further Legislative Work  

Representatives of the Ministry of Finance and KAS recalled that the legislative process was divided into two stages.   

The first stage involved postponing the obligation to implement the KSeF until February 1, 2026. For more information, see the press release: Link

The second stage involves the phased implementation of the mandatory KSeF:  

 

  • Starting February 1, 2026 for entrepreneurs whose sales value in 2025 exceeded PLN 200 million.  
  • From April 1, 2026 for the remaining entrepreneurs.  

  

The meeting also discussed simplification proposals, such as the use of offline mode during the transition period and the possibility of issuing invoices up to PLN 450 outside KSeF.  

 

New Solutions and Functionalities in KSeF  

During the consultations, representatives of the Ministry of Finance and KAS presented the planned new functionalities of the KSeF system, including:  

  • The ability to send attachments to invoices, which is particularly important for industries issuing invoices with complex data.  
  • Modification of the logical structure of an e-invoice, including the rules for indicating the payment deadline.  
  • Alignment of KSeF environments to allow full implementation of business functionalities.  

  

Krzysztof Rogowski, Director of the KAS Analysis Department, noted that stable implementation of KSeF at businesses is a priority. Alignment of KSeF environments is aimed at managing and implementing changes in different KSeF environments and versioning them.  

  

KSeF Update – Questions and Answers  

During the meeting, participants had the opportunity to ask questions, which were answered on a regular basis by representatives of the ministry. The most frequently recurring questions will be successively posted on the website podatki.gov.pl in the section of questions and answers concerning KSeF.   

 The consultation meeting on KSeF showed that the Ministry of Finance and KAS are open to dialogue with entrepreneurs and strive to develop optimal solutions. New functionalities, such as the ability to send invoice attachments and the phased implementation of the mandatory KSeF, are intended to make it easier for entrepreneurs to adapt to the new system. The next legislative steps and consultations will be crucial for the final form of KSeF, which will take effect from 2026.
