Postponement of the Deadline for Mandatory KSeF Implementation
On January 19, 2024, there was an unexpected twist. On that day, the Ministry of Finance announced a change in the KSeF effective date for all businesses. Find out what’s next for KSeF and the possible date of its implementation.
What is known about the postponement of the mandatory KSeF implementation date?
The Ministry of Finance invited journalists to a press briefing on January 19, 2024 at 9:45 a.m. The invitation was sent just a day earlier. The briefing featured Finance Minister Andrzej Domanski and KAS head Marcin Loboda. Together they cancelled the date for the mandatory introduction of KSeF.
Words were spoken about the fact that there are serious errors in the KSeF system. The biggest concerns are related to the capacity of the system. This could lead to a situation where entrepreneurs will not be able to issue invoices, because the National e-Invoice System will not handle such a large number of documents.
Such a situation would be detrimental both to entrepreneurs, who would not be able to properly document business transactions, and to the state budget, as taxes on issued invoices are at stake.
From When Will the KSeF System in SAP be Mandatory?
Finance Minister Andrzej Domanski announced that: “this year the mandatory KSeF will definitely not be in place”. This means that KSeF in 2024 will still be voluntary for all taxpayers. This is in line with the appeals of entrepreneurs, accounting experts and tax advisors, who have raised their concerns with the MF.
At present, it is unclear from when all businesses will be required to issue e-invoices using KSeF. The information coming from the MF is worth noting: “We will give the date on the basis of the audit. It can’t be a date that is dictated by some whim, political calculation, shifting. It must be based on what an external audit will show.”
Therefore, only time will tell if the mandatory KSeF will be in place as of January 1, 2025, or if an even later date will come into play.
What’s Next for the Deferred KSeF for Entrepreneurs?
The mandatory National e-Invoicing System will sooner or later become a reality. The Finance Ministry sees both the need for and the benefits of a mandatory KSeF.
In addition, EU regulations come into play. The ViDA (VAT in Digital Age) package published in December 2022 requires member states to use e-invoices from 2028 at the latest. This is all in the framework of sealing the tax system and fighting the VAT gap.
This means that Polish companies will also have to issue structured invoices. For this reason, it’s a good idea to prepare now for the upcoming changes.
